The ECHR Verdict calls for Civil Sovereignty that Europe has annulled

Professor Dr. Zlatko Hadzidedic said yesterday at the Circle 99 session in Sarajevo that the verdict of the European Court of Human Rights (ECHR) in the case of Kovacevic v. Bosnia and Herzegovina (BiH) represents the return of the principle of civil sovereignty, which Europe itself refers to as one of its most sacred legal achievements.

Speaking as the keynote speaker on the topic “Return to common sense: The ECHR verdict in the Kovacevic case”, Hadzidedic recalled that this principle existed in BiH from the end of the Second World War until 1992 and the so-called Lisbon Agreement, when it was annulled and removed by means of an initiative for the ethnoreligious division of the country known as the Carrington-Cutileiro plan, which was imposed on that occasion by the then European Community.

“Let’s not fool ourselves, not everything that comes from Europe is good, we got exactly what we attribute to ourselves as classic primitivism and self-destructiveness, but it is something that was imposed on us as a recipe in 1992,” Hadzidedic pointed out.

He added that acting completely opposite to the principle of civil sovereignty on which the constitutions of all European states are based, the European Community in Lisbon introduced a previously unknown principle of sovereignty based on ethnoreligious homogeneity according to Carrington and Cutileiro, which was later accepted in the Dayton Agreement and its Annex 4, which established the Constitution of BiH.

“As the ultimate paradox with which we were honored, the only remaining trace of sovereignty, that is, the capacity to make definitive decisions within one’s own territory, was kept in the form of the institution of the High Representative, which in itself, as an institution of practically colonial management of the state, represents a direct negation of its sovereignty and a negation of the very principle of sovereignty,” he emphasized.

He stressed that in order to survive, BiH must adopt a new constitution which, like all other republican constitutions, will start from the sovereignty that belongs to the citizens, whose common will is realized through institutions in the form of state sovereignty that is a priori indivisible, non-transferable and unquestionable.
